MusePrompt: AI Photo Prompts

These Terms & Conditions ("Terms") govern your use of the mobile application MusePrompt: AI Photo Prompts (package: com.novixalabs.museprompt), published by Novixa-Labs ("we", "us", or "our"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. About the App

MusePrompt is an offline visual AI photo prompt builder and library for Android. You can browse categories, preview images, assemble prompts from options, save and copy prompts, and open external AI tools to continue your creative work.

The app does not generate images, photos, or videos. Any image generation happens only in third-party tools you choose to open. MusePrompt is independent and is not affiliated with, endorsed by, or sponsored by those tools.

2. Eligibility

You must be able to form a binding contract under the laws of your country to use this app. If you are under the minimum age required in your jurisdiction, you may use the app only with permission from a parent or legal guardian.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, solely for personal, non-commercial use and in accordance with these Terms and applicable law.

You may not:

• Use the app for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract the source code of the app except where permitted by law
• Copy, modify, distribute, sell, or lease any part of the app without our written permission
• Use the app for harmful, abusive, or fraudulent purposes
• Interfere with or disrupt the app or any network
• Click ads fraudulently or attempt to bypass advertising or payment systems

4. Your Content & Prompts

Prompts you assemble, save, or copy remain under your control on your device. You are responsible for the content of prompts you create and for how you use them in third-party services. Do not create or distribute illegal, harmful, or infringing content.

5. Content & Intellectual Property

The app, its design, branding, catalogue structure, and software are owned by Novixa-Labs or its licensors. These Terms do not transfer any ownership rights to you. Preview images and catalogue materials are provided for in-app browsing and prompt assembly only.

6. Advertising

The free version of the app may display advertisements served through Google AdMob and, as a fallback when AdMob has no fill, Unity Ads for interstitial and rewarded videos. Where required, consent is managed with Google UMP. Ad availability varies by region and device.

You agree that:

• Ads are part of the free experience unless you purchase MusePrompt Pro
• Optional rewarded videos may unlock a single Pro prompt style after you complete the video
• Third-party ad networks are responsible for ad content under their policies and applicable law
• We may change ad placement, frequency, or partners to improve sustainability and user experience
• You will not click ads fraudulently or attempt to bypass advertising or payment systems

7. In-App Purchases (MusePrompt Pro)

We offer a one-time, non-consumable in-app purchase (MusePrompt Pro, product ID museprompt_pro) through Google Play Billing.

When you purchase MusePrompt Pro:

• Advertisements are disabled in the app on that Google account (subject to successful purchase verification)
• Every Pro prompt style is unlocked
• The purchase is tied to your Google Play account and may be restored after reinstall

Prices, taxes, and refunds are handled by Google Play under Google's terms. We do not process payments directly. Purchases are generally non-refundable except where required by law or Google Play policy.

8. External Services

Opening external AI tools leaves MusePrompt and is subject to those services' terms, availability, and policies. We do not guarantee that any third-party tool will accept, process, or generate results from a prompt you copy.

9. Updates & Changes

We may update the app, its advertising, pricing, catalogue, or these Terms from time to time. Continued use after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the app will work on every device or Android version, that every catalogue item will remain available, that ads will always fill, or that purchases will always restore instantly. We do not guarantee any creative or commercial outcome from prompts you build.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVIXA-LABS AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY THIRD-PARTY SERVICE YOU OPEN FROM THE APP.

Our total liability for any claim relating to the app shall not exceed the amount you paid us for the app or in-app products in the twelve (12) months before the claim (or zero if you paid nothing).

12. Termination

You may stop using the app at any time by uninstalling it. We may suspend or discontinue the app or any feature if required by law, store policy, or operational needs.

13. Privacy

Your use of the app is also governed by our Privacy Policy, which explains local storage, advertising, consent, and purchases. Please read it at https://novixa-labs.vercel.app/museprompt/privacy.html

14. Third-Party Trademarks

MusePrompt is an independent product. Names such as Gemini, ChatGPT, Midjourney, Flux, and Stable Diffusion are trademarks of their respective owners. Mentions are for compatibility / handoff reference only and do not imply endorsement or affiliation.

15. Governing Law

These Terms are governed by applicable laws in the jurisdiction where Novixa-Labs operates, without regard to conflict of law principles. Mandatory consumer protection laws in your country may still apply.
